Welcome to Horeb African Store, and thank you for registering with us. We are horebafricanstore.co.uk, a member of Horeb Limited a company registered in England under number 13655951 whose registered office is at 124 City Road, London, England, EC1V 2NX.
It is important that you review this agreement because by placing an order with us by telephone, fax, email, or online, you agree to the terms of this Agreement (the “Agreement”) which shall cover the terms of our deliveries to you and your use of our website. This Agreement is between you and Horeb, (the “Company” or “Horeb”) that states the terms and conditions under which you may use the Site and receive deliveries from us.
OUR DELIVERY SERVICE
When you place an order, we use all reasonable effort to deliver to you as per the terms set out by our Delivery partners (Hermes, Royalmail, DHL, DPD, FedEx). Any delivery charge added to your order will be dependent upon, amongst other things, the value and weight of your order and the date and time of your delivery. If something is missing from your order, please contact us so that we can do everything reasonable in our power to ensure your satisfaction.
While we are committed to delivering a seamless experience to you and within the guidelines of our delivery SLAs, situations outside our control (e.g. Delays from our Delivery partners, National Postal Strike Actions, Adverse Weather Conditions etc) may impact delivery timescales offered by our Delivery Partners.
We are not liable for delays due to incorrect addresses provided to us by Customers. It is your responsibility to provide a correct delivery address and ensure that an appropriate person is available at the delivery address at all times during the delivery slot. Please note that Horebafricanstore.co.uk will not accept liabilities that may arise from missed deliveries because of the nature of the goods supplied being fresh/frozen alongside the dry ones.
In the event that you instruct Horebafricanstore.co.uk/DHL/Parcelforce (or any of our 3rd Party Delivery Partners) to leave a delivery unattended at your address, Horeb expressly disclaims all liability which may arise by virtue of the delivery being left unattended for a period of time. This includes but is not limited to theft, tampering, contamination and the result of any change in temperature in respect of items which need to be kept chilled or frozen.
PRICE AND AVAILABILITY
From time to time, products you order may be unavailable. If we are unable to fulfill your entire order, we will make every reasonable effort to substitute the closest product.
PAYMENT
We accept payment via Apple Pay, PayPal and Credit/Debit cards. In the event your card/payment type is declined, we reserve the right to collect funds for any uncollected transactions owed us should a payment made via credit card be declined. If you fail to pay any fees or charges when due, we may charge such amount directly to the credit card identified in your Customer Account Information and we may suspend or terminate your access to our Service. You shall be responsible and liable for any fees, including but not limited to attorney’s fees and collection costs, that we may incur in our efforts to collect any unpaid balances from you.
COPYRIGHT AND OWNERSHIP
Designs, and interfaces; the collection, selection, and arrangement thereof; and all software are the property of, or duly licensed to, Horeb. Consent is granted to view all of such things for the sole purpose of placing an order with us. You are not authorized to save or collect any such information. Any other use of materials on this Site, including modification, distribution, or reproduction is strictly prohibited. You acknowledge that Horeb and/or third-party content providers remain the owners of such material and that you do not acquire any of those ownership rights by downloading copyrighted material. Horeb reserves the right to revoke your use of the Site.
TRADEMARKS
Horeb, www.horebafricanstore.co.uk, the Horeb logo, graphics, trademarks, and/or trade dress of Horeb are proprietary to Horeb and may not be used by you for any reason. All other trademarks, service marks, product names, and company names or logos appearing on the Site are the property of their respective owners and you do not acquire any ownership rights in such marks, logos, or names by using this Site or our service.
You hereby represent that you are an adult (18 years or older) and have the power and authority to enter into this Agreement and perform your obligations hereunder.
PRIVACY
Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information. For the purposes of these Terms and Conditions: ‘Data Protection Laws’ means any applicable law relating to the processing of Personal Data, including, but not limited to the GDPR.
- ‘GDPR’ means the UK General Data Protection Regulation.
- ‘Data Controller’, ‘Personal Data’ and ‘Processing’ shall have the same meaning as in the GDPR. We are a Data Controller of the Personal Data we Process in providing Goods to you. Where you supply Personal Data to us so we can provide Goods to you, and we Process that Personal Data in the course of providing the Goods to you, we will comply with our obligations imposed by the Data Protection Laws:
- before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected;
- we will only Process Personal Data for the purposes identified;
- we will respect your rights in relation to your Personal Data; and
- we will implement technical and organisational measures to ensure your Personal Data is secure.
YOUR PERSONAL INFORMATION
You agree and accept responsibility for keeping all your account information current, including name, credit card information, telephone number, and e-mail address. You can update your information anytime that you place an order. You agree that you will not provide fraudulent information and that you are solely responsible for any information you provide to us. You will comply with all laws applicable to your activities on the Site and with this Agreement. Our secure server encrypts your credit card information, among other things so that it cannot be read as the information travels over the Internet. All payment is done via our trusted payment gateways: Stripe & PayPal will exercise commercially reasonable efforts to ensure that your credit card information remains confidential at all times. When our order form asks users to enter sensitive information, such as a credit card number, that information is encrypted and is protected with encryption software. Stripe meets and exceeds the most stringent industry standards for security. Stripe are also audited by a PCI-certified auditor, and are certified to PCI Service Provider Level 1, which is the highest level of certification available.
YOUR RIGHTS
You have a legal right to receive goods which comply with their description, which are of satisfactory quality and which comply with any specific requirements you tell us about (and we agree to) before you place your order.
Please note that Products or product packages may differ slightly to those displayed on our website, and should you have any doubt about any product please contact us.
Should your order arrive damaged or missing, please contact us at info@horebafricanstore.co.uk, and we will immediately try to rectify. Please note though, that we can only offer refunds for items if they arrive damaged, or missing.
Our refund and returns policy for Non Perishable items lasts 14 days from delivery. If 14 days have passed since your purchase, we cannot offer you a full refund or exchange.
Our refund and returns policy for Fresh Produce & Perishable items (this includes Fresh Vegetables, Fruits, Yams, Plantains, Bread, Peppers, Okras) is 24 hours from delivery. For Perishable items please contact us within 24 hours of delivery of your order to advice of missing and/or damaged items.
Please note that we can only process complaints on perishables like Fresh Vegetables, fruits, plantains, okra , yams within 24hrs of delivery. You can please peel, freeze and later cook frozen to preserve quality as the weather doesn’t help. Thanks.
To preserve the freshness of your vegetables, orders containing fresh produce will only be dispatched Mondays to Thursdays.
If 24 hours have passed since your purchase with Fresh Produce & Perishable items was delivered, we cannot offer you a full refund or exchange.
We may request a photograph showing the problem if it is something that can be seen by inspecting the Items.
We will provide a refund or account credit in respect of the affected part of the Item, and also in respect of delivery if the whole order was affected, unless we have reasonable cause to believe that the problem was caused after delivery. Items must be returned to us within 14 days of receipt of goods.
For non-perishable items you can cancel or amend your order before it is processed and dispatched at no charge. However if your order has been dispatched prior to our receipt of your cancellation or amendment request, you may return the goods (in good condition) within 7 days for a refund but you will not be liable to refund you the shipping and delivery cost incurred.
ACCEPTABLE USE POLICY
You agree not to engage in unacceptable use of our service, site, or systems in a manner that breaches any applicable local, national or international laws.
WARRANTIES AND LIABILITY
We are not liable or responsible for the availability or quality or content provided on any third party websites. You should refer to the terms and conditions and other policies posted by other third party websites.
The content and images on our site is provided for general information only. Products or product packages may differ slightly to those displayed on our website. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site. Should you have any doubt about any product please contact us.
You expressly agree that use of our service, the site is entirely at your own risk. Our service, the site, and its contents are provided on an “as is”, “as available” basis.
We do not warrant that the functions provided by the site will be uninterrupted or error free
JURISDICTION AND APPLICABLE LAW
The English courts will have jurisdiction over any claim arising from, or related to, a visit to our Site or use of our Services. In the event of any dispute you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
FUTURE AMENDMENTS
Horeb may amend this Agreement at any time by posting the amended terms on our Site. All amended terms shall automatically be effective at the time they are initially posted on our Site. By accessing this Site after the effective date of any such amendment, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Agreement to which you are bound. Customers who prefer to place order by telephone agree to be bound by the terms of this Agreement, as amended from time to time. In all cases, as a condition of making deliveries to you, you agree to review this Agreement from time to time.
If you do not agree with the terms of this Agreement, you may terminate your acceptance by emailing us at info@horebafricanstore.co.uk and by no longer accessing our website.
